PROVIDING COMMUNITY CONCERNS AND COMPLAINTS

We welcome community feedback and concerns regarding our business, operations, ways of working and general ideas. Having a robust, reliable and accessible way the community can submit concerns regarding our work helps ensure we live our values. An important part of that is providing timely answers, feedback and, when applicable, remediation. We want to ensure the protective rights of any person or community that could be affected by our actions or activities.

TABLE OF CONTENTS

A community complaint is a verbal or written notification made directly to a South32 representative by a member of the community relating to an adverse impact on the community from the Company’s activities and/or employee or contractor behavior in part or in whole.

Stakeholders are encouraged to raise and share any questions, concerns, feedback (both positive and negative), or other respectful communications regarding South32 activities.

  • Speak to one of our Community Specialists in either the Patagonia or Nogales office. You may also share comments, complaints or concerns to someone from our Communities team during public engagements, such as meetings or community events.

Community Cards are available from employees actively engaging with the public, as well as at our Patagonia and Nogales offices. These cards include the contact information needed to submit a question or concern.

  • Call our Community Information and Concerns voice mailbox at 520-848-1330, 24-hours a day, 7 days a week (in English or in Spanish). We will confirm receipt within 48 business hours if personal details are provided. You are welcome to remain anonymous. However, to enable us to respond to your inquiry, please provide a phone number, email address, or another method of contact.

You may also submit a question or Community Concern via our online form found HERE (South32 Hermosa Contact Page).

Regardless of how you reach out to us, we guarantee that the your identity will remain anonymous if you choose. Under no circumstances will there be any retaliation against individuals using any means to submit feedback, regardless of the information they share or raise.

  • Receipt: We receive questions or concerns from the community in person or via phone, email, physical drop box, online, or mail. The more details regarding the questions or concerns that are provided, the better we can understand and address your concern.

If sufficient information is not provided, we may not be able to fully investigate the issue. Questions or concerns can be submitted anonymously; however, this will not allow us to follow up with you.

  • Confirmation: We will confirm receipt of the question or concern within 2 business days (unless submitted anonymously).
  • Review: If the concern raised meets the Complaint criteria, we will coordinate with the appropriate internal experts/contact points to review the concern. We will reach out to you within 2 business weeks, either to provide you with a response, update, or to acknowledge that more time is required to fully address your concern. If the review determines that a formal investigation is necessary, the matter will be escalated accordingly, and appropriate actions will be taken based on the situation. Any resulting actions or outcomes will be communicated to you directly.
  • Response: We will provide a formal response to whomever raised the issue by phone, email, in person, or by mail. As noted above, appropriate contact information must be provided to receive a response. If the community member remains unsatisfied with the outcome, the Hermosa Leadership Team (HLT) will evaluate whether a higher level of review or further action is appropriate, based on all the information provided by and requested from the Complainant. This could require third party intervention or adjudication to resolve. This process may involve more than one community member or family and relate to disputes that have remained unresolved for some time. This could include facilitating an independent 3rd party for validation and ensuring process equity.
